These Terms of Service ("Terms") govern your use of SiteNotes, an iOS application made by Banruo Yang in New South Wales, Australia ("Banruo Yang", "we", "us", "our"). SiteNotes is built for construction professionals — project managers, foremen, site engineers, and builders — to capture site activity in the field.
Please read these Terms carefully. They are a binding agreement between you and Banruo Yang.
1. Acceptance of terms
By downloading, installing, or using SiteNotes, you agree to be bound by these Terms. If you do not agree, do not install or use the app. If you are using SiteNotes on behalf of an employer or organisation, you confirm that you have authority to accept these Terms for that organisation.
2. Apple's Licensed Application End User License Agreement
SiteNotes is distributed through the Apple App Store. Your use of the app is also governed by Apple's standard Licensed Application End User License Agreement (the "Apple EULA"), available at:

The Apple EULA forms part of your agreement with us and is incorporated here by reference. These Terms are supplemental to the Apple EULA — they do not replace it. Where the Apple EULA covers a matter, the Apple EULA applies. Where these Terms add to or clarify topics the Apple EULA does not address, these Terms control.
You acknowledge that this agreement is between you and Banruo Yang, not between you and Apple. Apple is not responsible for the app or its content. Apple is a third-party beneficiary of these Terms and may enforce them against you.
3. What SiteNotes does
SiteNotes is a local-first construction site logging tool. The current version provides:
- Text, photo, and voice-note capture tied to a site or project
- On-device speech-to-text transcription of voice notes
- Optional location capture (one fix per record) for site detection and weather lookup
- Daily site diary, inspection templates, and structured log entries
- PDF export of site reports and diaries
- iCloud sync of your data through your own Apple ID
SiteNotes is a tool to help you record work. It is not a substitute for professional judgement, regulatory compliance systems, or formal record-keeping required by contract or law.
4. No SiteNotes accounts; use of Apple ID
SiteNotes does not have its own account system. There is no sign-up, no password, and no email registration with Banruo Yang.
Where the app syncs data across your devices, it does so through your own iCloud account, using the Apple ID already configured on your iPhone or iPad. Banruo Yang never sees your Apple ID and has no access to your iCloud data. Your relationship with Apple regarding your Apple ID and iCloud is governed by your agreement with Apple.
You are responsible for keeping your device, your Apple ID credentials, and your iCloud account secure.
5. Your content
You own everything you put into SiteNotes — your notes, photos, voice recordings, transcripts, drawings, sketches, site data, exported PDFs, and any other content you create or import ("Your Content").
Banruo Yang claims no ownership of Your Content and no licence to use it beyond the limited, technical processing required for SiteNotes to function on your device (for example, rendering a PDF you asked the app to export). Because Your Content stays on your device and in your private iCloud container, we do not receive, store, or have access to it on our servers.
You are responsible for Your Content, including its accuracy, legality, and any backups you choose to keep. We strongly recommend you keep separate backups of records that may have legal, contractual, or regulatory significance.
6. Acceptable use
You agree not to use SiteNotes to:
- Record audio, video, or images of any person in a manner that violates applicable privacy, surveillance, or workplace recording laws (rules vary by Australian state and by country — you are responsible for knowing what applies on your site)
- Record protected, classified, or restricted facilities without authorisation
- Capture, store, or distribute content that is unlawful, harassing, defamatory, or infringes another person's rights
- Reverse engineer, decompile, disassemble, or attempt to extract the source code of the SiteNotes binary, except to the extent this restriction is prohibited by applicable law
- Modify, redistribute, sublicense, sell, or commercially exploit the SiteNotes app itself (you may freely use the app's output — your own reports — for commercial purposes)
- Use SiteNotes to build, train, or evaluate a competing product
- Interfere with the integrity or security of the app, or attempt to bypass technical limitations
We may, at our discretion, refuse service, request removal of the app, or report serious misuse to Apple or to relevant authorities.
7. Subscriptions and billing
Version 1 of SiteNotes is free. There are currently no subscriptions, no in-app purchases, and no paid tiers.
We reserve the right to introduce paid features, subscriptions, or other commercial tiers in future versions. If we do, the relevant pricing, billing, renewal, and refund terms will be presented to you through the App Store at the point of purchase, will be processed by Apple under your Apple ID agreement, and will be added to or referenced in these Terms. Continued use of paid features after such terms are presented constitutes acceptance of them. Free features available to you today will not retroactively become paid.
8. Privacy
Our handling of personal information is described in the SiteNotes Privacy Policy, available at:

The Privacy Policy is incorporated into these Terms by reference. In short: we do not operate servers that hold your SiteNotes data, and your notes stay on your device and in your own iCloud.
9. Third-party services
SiteNotes makes limited use of third-party services to deliver specific features:
- Apple iCloud / CloudKit — for syncing your data inside your own Apple ID
- Open-Meteo — for weather information attached to records (no personal data sent)
- Apple Speech, MetricKit, MapKit, and related Apple frameworks
Your use of these services is governed by the terms of the relevant provider. We are not responsible for the availability, accuracy, or content of third-party services.
10. Disclaimers
To the maximum extent permitted by law, SiteNotes is provided "as is" and "as available", without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
In particular, you acknowledge that:
- Automatic speech-to-text transcription is best-effort and may contain errors
- Weather data is provided by a third party for general reference only
- Location, site detection, and time stamps depend on device sensors and may be imprecise
- AI-assisted features (such as classification, summaries, or suggestions) produce suggestions only — they are not authoritative and must be reviewed by you before being relied upon
- Records produced in SiteNotes may not be sufficient on their own for legal, contractual, regulatory, or evidentiary purposes — you must independently verify and corroborate any record before using it in such contexts
We do not warrant that the app will be uninterrupted, error-free, or compatible with every device or iOS version.
Nothing in this section excludes any consumer guarantees that cannot lawfully be excluded under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)).
11. Limitation of liability
To the maximum extent permitted by Australian law, Banruo Yang's total aggregate liability arising out of or relating to SiteNotes or these Terms — whether in contract, tort (including negligence), statute, or otherwise — is limited to the amount you paid Banruo Yang for SiteNotes in the twelve (12) months immediately before the event giving rise to the claim. In version 1, where the app is free, this amount is likely to be AUD $0.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of business, loss of data, or loss of goodwill, even if we have been advised of the possibility of such damages.
Where the Australian Consumer Law applies and the relevant guarantee cannot be excluded, our liability for a breach of that guarantee in relation to services is limited (at our option) to re-supplying the services or paying the cost of having them re-supplied.
12. Indemnification
You agree to indemnify, defend, and hold harmless Banruo Yang and its directors, employees, and contractors against any third-party claim, demand, loss, damage, cost, or expense (including reasonable legal fees) arising from or related to:
- Your use of SiteNotes in breach of these Terms or applicable law
- Your Content, including any claim that Your Content infringes a third party's rights or breaches privacy or surveillance laws
- Your misuse of the app to record, store, or share information without proper authority
13. Termination and changes to the service
We may, at any time and at our sole discretion:
- Modify, suspend, or discontinue SiteNotes or any feature
- Remove the app from the App Store
- Cease publishing updates or security patches
- Terminate your right to use the app if you materially breach these Terms
You may stop using SiteNotes and uninstall the app at any time. Termination does not affect Your Content stored on your device or in your iCloud — that remains under your control.
Sections that by their nature should survive termination (including ownership of Your Content, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply after termination.
14. Open-source notices
SiteNotes incorporates open-source components. Attribution and licence notices for those components are made available within the app under Settings → Open Source Licenses. Your use of those components is governed by their respective licences.
15. Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia, and the laws of the Commonwealth of Australia that apply in NSW.
You and Banruo Yang submit to the exclusive jurisdiction of the courts of New South Wales, Australia (and the courts competent to hear appeals from them) for any dispute arising out of or relating to these Terms or SiteNotes.
Nothing in this section limits any non-excludable right you may have under the Australian Consumer Law to bring a claim in a forum of your choosing.
16. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and post the new version at https://banruo1019.github.io/SiteNote/terms/. For material changes, we will use reasonable means to notify users (for example, an in-app notice on the next launch after the change).
Your continued use of SiteNotes after a change takes effect constitutes acceptance of the updated Terms. If you do not accept the change, your remedy is to stop using the app and uninstall it.
17. Miscellaneous
- Entire agreement. These Terms, the Apple EULA, and the Privacy Policy together form the entire agreement between you and Banruo Yang regarding SiteNotes.
- Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
- No waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms. We may assign them to a successor in connection with a corporate transaction, on notice to you.
- Headings. Section headings are for convenience only and do not affect interpretation.
